Leasing Commercial Space

Finding a commercial premises is only the first part of taking a lease. Before agreeing terms, confirm that the premises and proposed use suit your business and that the full cost, fit-out and obligations are understood. Understand the lease terms

Ask your commercial lawyer to review the proposed lease and disclosure material before you sign. Check the permitted use, lease term, commencement date, renewal and rent-review provisions, security or guarantees, assignment and subletting rights, default provisions and how the lease can end. Confirm whether rent is quoted plus GST and outgoings, how outgoings are calculated and reconciled, and which repairs, maintenance, insurance and compliance costs sit with the tenant.

Plan the fit-out and operation

If a fit-out is needed, document who approves, pays for, owns and maintains each item, and what must be removed or reinstated when the lease ends. Check building access, parking, signage, loading, operating hours, utilities and internet. Confirm any required resource consent or building approval with the relevant Council and qualified professionals. For food, health, education or other regulated uses, check additional approvals with the responsible authority before committing.

Inspect and confirm before signing

Inspect the premises and services, ask for current building and compliance records relevant to your use, and obtain independent building, fire or engineering advice where appropriate.
